Patient data protection

 

During treatment in our clinic / therapy center, we collect and process different types of data about you, in particular administrative and medical data.

Your illness, diagnoses, results of examinations etc. are documented in your patient file. You have the right to view your patient file (for more information see point 1.11).

During rehabilitation, we work with technical devices from different companies. For this purpose, software is often used to monitor and optimize your treatment. At most, these companies receive pseudonymized data from you; since this data is pseudonymized, your identity is not known.

 

 

General data protection and medical confidentiality are closely related. Confidentiality protects the relationship of trust between patient and doctor, or support staff. Violation of medical confidentiality may be punished both criminally and disciplinarily.

A confidentiality waiver is possible:

a) with your consent

b) with approval from the relevant authority

c) where there is a legal obligation to report



Upon admission, a photo (portrait) is taken, with your agreement. This makes it easier to identify you. It also makes it easier to identify all of the people undergoing treatment.

During your stay, the rehab clinic takes films, photos and audio recordings to document the treatment process. Your consent is obtained for any additional use (publications, brochures etc.) We guarantee that recordings will not be handed over to unauthorized third parties. Your personal data may also be used for internal quality assurance in line with statutory regulations.

The clinic processes the following personal data (hereinafter all categories together as “data”) about you:

a. Administrative data/master data: This data includes surname, name, address, date of birth, nationality, sex and possible religion (“Administrative data”)

b. Medical data / case data: This includes your medical history, in particular all medical information which we learn about you from your admission to discharge, such as diagnoses on admission and discharge, examinations, therapies, surgery, medical reports, medication, lab analyses, nursing reports (“Medical data”). Films, photos and audio recordings are also made to document your therapy. This data is usually collated in your patient file (“Patient dossier”). When you train with technical devices, your performance (e.g., duration, distance, intensity of training) is also recorded (“performance data”).

The data referred to are essentially medical data, which is considered particularly sensitive.

 

The clinic requires medical data for the care and treatment of our patients, for quality purposes, and for patient administration.

 

As a rule, data will not be passed on to third parties unless:

  • You have expressly authorized us, for example to follow-up treatment institutions, family members – supported by a legal basis (e.g., disclosure to health/accident insurers based on the Health Insurance Act or Accident Insurance Act);
  • There is a legal obligation to report, as with infectious diseases, criminal offenses, etc.

The clinic has appropriate technical and organizational security measures in place to protect your data.

 

Usually, your data is processed within Switzerland. When data is processed outside of Switzerland, this only takes place in countries with an appropriate level of data protection.

 

The data is stored in accordance with the statutory retention periods; these are at least 20 years, but in individual cases may be 30 years.

In principle, the data is stored within the clinic’s internal infrastructure. Certain performance data relating to the use of technical devices can also be stored in the cloud that complies with the VITREA Group’s security standards. Data is stored only in pseudonymized and encrypted form and only on servers located in Europe or Switzerland, which are therefore subject to high data protection standards.

 

1.11.1 Right to information and correction, etc.

Within the scope and extent of the applicable legal provisions, you have the following rights:

a. Right of access: You have the right to obtain information about all of your personal data, including a free copy. You do not need to give a specific reason for doing so.

b. Right to rectification: You have the right to have inaccurate personal data about you corrected. Incomplete data must be completed. However, you must provide a reason for doing so. In addition, you may request that a correction be communicated to third parties.

Corrections can only be made in the case of objective facts; in the case of subjective opinions, you can have a counterstatement or a note added.

c. Right to erasure: If there is a reason for erasure, you can request the deletion of data concerning you, provided that there are no longer statutory retention periods.

d. Right to object and to restriction of processing: You have the right to object to the processing of your data. This will not delete your data, but it will restrict its further use.

 

When data processing is based on your consent, you can revoke this consent at any time in writing, by email, telephone, or fax to the address below. It is not necessary to give a reason. Please note that the withdrawal only applies from the moment you declare it. Any data processing carried out up to this point remains lawful.
